No. You have no obligation to give a statement to the other driver’s insurance company. In fact, you should not give a statement to the other insurance company. You do have an obligation to give your own insurance company a statement. You do have the right to have your attorney present for the statement you give to your insurance company.

Yes- if you cannot pay the amount claimed or you question the amount, you need to immediately send a letter to the attorney and request verification of the amount. There are very specific statutory deadlines and procedures in Maryland to contest these amounts. If you do act within those deadlines and as the procedures require, you will lose your right to dispute the amount claimed.
